Q. Can you get a restraining order for verbal abuse?

A. It depends on the specific circumstances. Despite what some will say, this really is a gray area. While no one should be abused in any way, including verbal abuse, the courts have strict guidelines on what constitutes grounds for the issue of a restraining order (order of protection). There is a big difference in the eyes of the court between someone making a nasty or rude comment, and someone who has displayed violent behaviors in the past, and is red-faced with anger while grabbing you and making threats that they are going to hurt you.

At Smith Law Group we carefully evaluate every case, and are honest with our clients about getting a restraining order for their particular situation. We do not want our clients to pay for something that we know will have a low likelihood of success; particularly when denial of a restraining order actually can empower the verbal abuser, and even escalate their behavior. This is something that we certainly do not want happening, and another important reason to evaluate each case carefully.

If you are in an abusive situation and need assistance, please reach out to us. Smith Law Group is always here to help!
