Juvenile Dependency
Juvenile Dependency cases concern family situations where allegations
of abuse or neglect have been made, and the juvenile court intervenes
to protect the family's children. Oftentimes, the first indication
to a parent that an issue with their children has arisen is when
the children are physically removed from the home. This is often
an emotional and gut wrenching situation for both the children
and the parents. It typically occurs after the parents have been
arrested, or when domestic violence has occurred in the household,
or when an allegation of abuse or neglect or drug use has been
made against the parents.
One of the goals of the Juvenile Dependency court is to have matters
regarding children resolved as quickly as possible, and they always
strive to do what is in the "best interest" of the children.
If a child becomes a dependent of the court, the court will make
orders directed at the parent, the child, sometimes relatives,
the social worker, or others so that the child will be protected.
Once a child is declared to be a dependent of the court, the court
will either allow the child to reside in the family home under
court supervision, or may place the child outside of the family
home, typically in a foster home or group home. If during the
time a child is a dependent of the court reunification services
are not ordered, or reunification efforts fail, the child is eligible
for adoption by a relative or third party.
There are many opportunities to have the children returned home,
and the court and all other agencies strive to accomplish this
main goal. Services are offered to assist the parents in becoming
better parents, or to help them overcome domestic violence, or
drug usage, or other problems that have been deemed to be detrimental
to the children. With true effort and cooperation on the part
of parents, the majority of parents and children are reunited,
and oftentimes enjoy better parent-child relationships after the
court's intervention.
As difficult and devastating as the removal of a child or children
can be, it is not the end of the world; things will work out and
life will get better for both the parents and the children. Immediate
assistance is available to parents from attorneys, both private
and court appointed. Do not hesitate to contact a qualified attorney
of your choice as soon as action has been taken against your family.
Prompt legal assistance can often mean the difference between
short or lengthy delays in reunification of parents with their
children.
