Q. Can a same-sex couple get a divorce in California, if they got married in another state?

A. The short answer is yes, but there are residency requirements. In California, same-sex couples are treated just like heterosexual couples when it comes to marriage and divorce. California is a no-fault state which means that if you and your spouse determine that you want to get a divorce, you can legally do so without having to prove any specific reason. Simply having irreconcilable differences is enough to proceed with a divorce in California.

If you and your spouse were married in another state, but now want a divorce in California, at least one of you must be a resident of California for six months, or longer. In addition, you need to have lived in the county you are filling in for at least three months.

Of course, as with any divorce there may be additional factors to consider, such as child custody and support, and division of assets.
